Purchase & Refund Policy

1. Our Commitment & Key Principles

Our goal at TixRocket (operated by Decibles Pty Ltd) is to make your purchasing experience easy, efficient, and equitable, so we can get you on your way to live events as quickly as possible. The following policy (‘Purchase & Refund Policy’) is designed to ensure your satisfaction and understanding of our purchase and refund processes. It applies to any purchase of tickets or related products made on or after March 2026.

Each ticket you purchase is a licence to attend a particular event and is subject to the terms set out in this policy, the additional terms set forth on that ticket, and any Event Specific Terms. This policy is subject to and incorporates by reference our Terms and Conditions and Privacy Policy.

Nothing in this policy is intended to limit or exclude any rights you may have under the Australian Consumer Law or other applicable consumer protection laws. However, it sets out the basis on which you agree to interact with our platform and the entities associated with it.

2. Important Terms at a Glance

Please ensure you read the full policy below. In particular, we draw your attention to the following key provisions:

  • Limited Refunds: You will only be entitled to a refund in the specific, limited circumstances set out in this policy (e.g., event cancellation) and subject to Event Specific Terms, unless required by applicable law. See Section 5 (Refunds) and Section 6 (Cancelled/Rescheduled Events).
  • Indemnification & Liability: Your purchase indemnifies TixRocket, Decibles Pty Ltd, Indianclubx, and all affiliated entities, including their managers, employees, directors, contractors, and staff, against certain claims. See Section 11 (Indemnification) and Section 12 (Limitation of Liability).
  • No Refund Guarantee: We maintain the right, at our sole and absolute discretion, to refuse any refund request not mandated by this policy or applicable law, especially where a customer refuses to acknowledge these Terms. See Section 5.5.
  • Legal Cost Recovery: In the event of a dispute, you may be liable for our legal costs. See Section 13 (Dispute Resolution & Legal Costs).

3. Event Information & Advertising

TixRocket lists events on behalf of Event Organizers. While we strive to ensure accuracy, we do not control and cannot guarantee the completeness or accuracy of all event information provided by organizers.

Advertisement Disclaimer: Event descriptions, artist line-ups, times, and other details are provided to us by the Event Organizer and are presented on our platform in good faith. You acknowledge and agree that TixRocket, Decibles Pty Ltd, Indianclubx, and their affiliates make no representations or warranties that any advertised event details are entirely free from error, and you cannot hold us liable for any claims based on allegedly false or misleading advertisements where we have reasonably relied on information supplied by the Event Organizer. Your sole remedy for issues with the event itself lies with the Event Organizer.

4. Ticket Pricing, Availability & Fees

Availability: Tickets are sold on behalf of Event Partners. We do not determine seating layouts, on-sale dates, or inventory. Tickets may sell out quickly, and we do not control the availability of additional tickets.

Pricing & Market Pricing: Ticket prices are set by the Event Organizer. Some tickets may be “market-priced,” meaning the price can increase or decrease at any time based on demand. You will not be entitled to a refund if the price of a ticket was lower before you purchased it, or if prices are reduced after your purchase.

Fees: The displayed price may include GST and per-ticket fees. Per-transaction fees (handling, delivery) are added at checkout. Handling fees cover our ticketing service costs. Delivery fees vary by method. These fees are generally non-refundable, except as required by law.

Pricing Errors: If we discover an error in the price of tickets you have ordered, we will inform you and give you the option to reconfirm at the correct price or receive a full refund. If we cannot contact you, we may cancel the order.

5. Refund, Exchange & Cancellation Policy

5.1 General Rule: No Refunds or Exchanges
All sales are final. Before purchasing, carefully review the event and seat selection details. Subject to your statutory rights under the Australian Consumer Law and the specific exceptions below, TixRocket does not offer exchanges or refunds for change of mind, incorrect choice, or inability to attend an event (including due to personal circumstances, travel issues, or weather).

5.2 Specific Exceptions (Where Refunds MAY Apply)
Refunds will only be considered in the following circumstances, and always at the discretion of the Event Organizer and in accordance with this policy:

  • Event Cancellation: As detailed in Section 6.
  • Event Rescheduling: As detailed in Section 6.
  • Statutory Rights: Where a major problem with the ticket or service is found that cannot be remedied, as defined by the Australian Consumer Law.

5.3 Lost, Stolen, or Damaged Tickets
We are not responsible for lost, stolen, or damaged tickets. Replacement tickets may be issued in limited circumstances (e.g., we can identify and cancel the original ticket) and at our discretion, but no refund will be given.

5.4 Non-Refundable Fees
Unless required by applicable law (e.g., Australian Consumer Law), our handling fees, delivery fees, and any other service fees are non-refundable, even if the face value of the ticket is refunded under the exceptions above.

5.5 Sole Discretion & Customer Acknowledgment
We reserve the right, in our sole and absolute discretion, to refuse any request for a refund, exchange, or credit, even in circumstances not explicitly covered above, unless mandated by applicable law. This includes, but is not limited to, situations where a customer refuses to understand or acknowledge these Terms and Conditions, the Purchase & Refund Policy, or any Event Specific Terms. By completing a purchase, you acknowledge that you have read, understood, and agreed to be bound by all terms, and you agree that your refusal to subsequently acknowledge them does not create a right to a refund.

6. Cancelled & Rescheduled Events

6.1 Notification: If an event is cancelled or rescheduled, we will use reasonable endeavours to notify you using the contact details in your account. However, we cannot guarantee you will be informed before the event date. You should monitor your account and our website for updates.

6.2 Cancelled Events: If an event is cancelled in full (and not rescheduled), the Event Organizer will determine if refunds are to be issued. If the organizer authorizes refunds, we will facilitate them. Typically, this will be a refund of the face value of the ticket(s). Our handling and delivery fees will generally not be refunded, unless specified otherwise or required by law. This is specified in the event information.

6.3 Rescheduled Events: If an event is rescheduled, tickets will usually be valid for the new date. If you notify us within a reasonable deadline specified by the Event Organizer that you cannot attend the new date, you may be eligible for a refund of the face value of the ticket(s). Our handling and delivery fees will generally not be refunded. Failure to notify us by the deadline will be deemed acceptance of the new date, and you will not be eligible for a refund related to the reschedule.

6.4 Event Organizer Responsibility: All decisions regarding refunds for cancelled, rescheduled, or materially altered events rest solely with the Event Organizer. TixRocket acts only as a facilitator and processes refunds as instructed by the organizer. We are not responsible for an organizer’s decision to deny refunds, where permitted by law.

7. Ticket Resale

Event Organizers may enable a resale feature, allowing you to resell tickets you cannot use. If available, this option will be accessible in your account. Terms, availability, and any applicable fees for resale will be disclosed at that time. Unauthorised resale of tickets is strictly prohibited and may result in cancellation of the tickets without refund.

8. Your Account & Conduct

You are responsible for maintaining the security of your account and for all activity on it. You must not create multiple accounts to circumvent ticket limits or these terms. We reserve the right to terminate your account, cancel orders, or prohibit future purchases if we reasonably suspect abusive, fraudulent, or illegal activity, or any breach of this policy or our Terms and Conditions. You are responsible for providing accurate information for contact tracing if required by health authorities or event partners.

9. Ticket Delivery

9.1 Methods: Tickets may be delivered via e-delivery (mobile or email), mail, or venue pickup, depending on the options chosen at checkout. You are responsible for ensuring your delivery details are correct and for accessing/downloading your tickets in time for the event.

9.2 Non-Delivery: We are not liable for non-delivery resulting from incorrect information provided by you, failure to accept delivery, or issues with your email/mobile device. It is your responsibility to check your tickets immediately upon receipt. Please report any errors within 5 days of receipt, or in good time before the event, as we may not be able to rectify issues later.

10. Attendance at Events

Your ticket is a revocable licence. Event Organizers and venues reserve the right to refuse admission to or eject any person for disorderly conduct, failure to comply with venue rules, or any other reason, without refund. You may be subject to search on entry. You consent to such searches. You also grant permission to the Event Organizer to utilize your image, likeness, and actions in any recording of the event. You assume all risks incidental to attending an event, including risks of illness or injury.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • No Liability for Event Organizer Actions: The TixRocket Parties are not responsible or liable for the acts or omissions of any Event Organizer, venue, performer, or other third party. Claims relating to the event itself (including quality, safety, or changes) must be directed to the Event Organizer.

  • Exclusion of Consequential Damages: In no event shall any of the TixRocket Parties be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages.
  • Cap on Liability: Where liability cannot be excluded by law (including, without limitation, liability under the Australian Consumer Law), the total aggregate liability of the TixRocket Parties to you for any claim arising out of or relating to these terms, your purchase, or your use of the platform shall be limited to the total amount of service fees actually paid by you to TixRocket for the specific transaction giving rise to the claim, or if no fees were paid, the sum of AUD $10.00.
  • Personal Arrangements: The TixRocket Parties are not liable for any wasted or unrecoverable costs or expenditure relating to personal arrangements (e.g., travel, accommodation) made by you in connection with an event, even if the event is cancelled or rescheduled.

Nothing in this clause attempts to exclude or limit liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.

13.1 Governing Law: This policy and any disputes arising out of or in connection with it shall be governed by the laws of Victoria, Australia.

13.2 Dispute Process: In the event of a dispute, we encourage you to first contact us at info@tixrocket.com to seek an amicable resolution. We will attempt to resolve the matter promptly.

13.3 Legal Costs: If any legal action, arbitration, or other proceeding is brought to enforce or interpret the terms of this policy, or in connection with any dispute arising from your purchase or use of the platform, the prevailing party shall be entitled to recover its reasonable costs and expenses incurred in connection therewith, including but not limited to legal fees, court costs, and the cost of producing affidavits, expert reports, court documents, or other evidence. This means that if TixRocket (or any of the TixRocket Parties) prevails in a dispute with you, you may be ordered to pay our legal costs.

14. Your Consumer Rights

Nothing in this Purchase & Refund Policy is intended to limit or exclude any rights you may have under the Australian Consumer Law or other applicable consumer protection laws. Our goods and services come with guarantees that cannot be excluded under such laws. For major failures with a service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for other reasonably foreseeable loss or damage. If a failure with a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

15. General Provisions

Changes to Policy: We may update this policy from time to time. The latest version will be published on our website, and your continued use of our services after an update constitutes acceptance of the revised policy.

Severability: If any part of this policy is found to be unlawful or unenforceable, that part shall be severed, and the remainder of the policy shall remain in full force and effect.

Entire Agreement: This policy, together with our Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and TixRocket regarding your purchase and use of tickets and related services, superseding any prior agreements.
